“The counterfeiting of medicines has developed into an industry that kills hundreds of thousands of people each year” (Council of Europe – 2007)
Medicine and drugs counterfeiting, forgery, diversion and smuggling is a scourge affecting 10% of the world medicine market. However, as identified during the conference “Europe against Counterfeit Medicines” in 2006, the problem is not being tackled in the right way: it is currently approached from the intellectual property side rather than the public protection side, which can render national authorities powerless. An international legal and technical instrument should therefore be developed to establish proof of a medicine counterfeiting crime, which will lead to criminal prosecution, as well as subsequent civil prosecution for property rights violation, should the rights holder decide to prosecute.
Another likely development will be the enforcement of pedigree requirements and medicine and drugs track and trace systems for supply chain security, by the USD Food and Drug Administration (FDA) and the European Medicines Agency (EMEA).
